TERMS AND CONDITIONS OF THE "GARAGE COFFEE BROS SUBSCRIPTION" SERVICE

This contract governs the subscription service called "Coffee Experience SMEG - Your machine in 12 months" offered by Garage Coffee Bros (hereinafter "Supplier") to the Customer (hereinafter "Subscriber").
1. SERVICE OBJECT
The service includes the monthly supply of coffee beans (Specialty Coffee) combined with the rental with purchase option of SMEG branded coffee preparation equipment. The subscription is available in 4 variants (Bundles):

Essential Style (SMEG Automatic Machine BCC11).

Design Combo (SMEG Automatic Machine BCC11 + SMEG Milk Frother MFF02 + GCB Cups).

Home Barista (SMEG Manual Machine EGF03 + GCB Cups + Training).

Prosumer Elite (SMEG Lever Machine EMC02 + SMEG Grinder CGF11 + SMEG Kettle/Gift KLF05 + Training).
2. DURATION AND TRANSFER OF OWNERSHIP (PURCHASE OPTION)
2.1 Duration: The contract has a binding duration of 12 (twelve) months starting from the subscription date. 2.2 Ownership Purchase: For the entire 12 months, the equipment remains the exclusive property of Garage Coffee Bros. Upon regular payment of the 12th monthly installment (twelfth payment), ownership of the entire equipment will be automatically and free of charge transferred to the Subscriber, who will become the 100% owner.
3. FEES AND PAYMENT METHODS
The Customer agrees to pay the fee according to the chosen plan. The billing methods vary depending on the Bundle to cover the value of the provided hardware:

"Essential" (€69/month) and "Design Combo" (€89/month) Plans:

Recurring monthly charge every 30 days starting from the purchase date.

"Home Barista" (€99/month) Plan:

Advance payment: At the time of subscription, a one-time charge of €297.00 is applied. This amount covers in advance the first 3 (three) monthly payments.

Fee: The monthly payment of €99.00 will automatically resume starting from the 4th month and continue until the 12th month.

"Prosumer Elite" (€199/month) Plan:

Advance payment: At the time of subscription, a one-time charge of €1,194.00 is applied. This amount covers in advance the first 6 (six) monthly payments.

Fee: The monthly payment of €199.00 will automatically resume starting from the 7th month and continue until the 12th month.

3.1 Non-Payment: In case of failure of the automatic charge, Garage Coffee Bros reserves the right to suspend coffee shipments and, if payment is not regularized within 15 days, to terminate the contract requesting immediate return of the equipment (see point 6).
4. SUBSCRIBER OBLIGATIONS AND MAINTENANCE
4.1 Diligent Use: The Subscriber agrees to use the machine exclusively for domestic or office use, following the provided instructions (including training where provided). 4.2 Ordinary Maintenance: The Subscriber is responsible for daily cleaning and periodic descaling of the machine.

Note: Damage resulting from failure to descale or neglect is not covered by warranty and will be charged to the Subscriber. 4.3 Prohibition of Transfer: The Subscriber may not sell, rent, or transfer the equipment to third parties until ownership transfer occurs (after the 12th month).
5. SHIPPING AND TRAINING
5.1 Shipping: Monthly coffee shipping costs are included in the fee. The first equipment shipment is included. 5.2 Training (Barista and Elite Plans): For plans that include training, it is the Subscriber's responsibility to book the video consultation session within the first 30 days of receiving the machine. Failure to attend the course does not entitle refunds.
6. EARLY TERMINATION AND PENALTIES
The Subscriber has the right to terminate the contract before 12 months, under the following conditions:
6.1 Return: The Subscriber must return at their own expense all received equipment (machines, grinders, accessories, milk frother) in good condition, complete with original packaging and accessories.
6.2 Penalties:

Garage Coffee Bros reserves the right to charge a restoration/refurbishment fee if the machine shows aesthetic or functional damage (up to 50% of the new value).

For plans with advance payment (Barista and Elite): In case of early termination, the advance paid (Quarterly or Semiannual) WILL NOT be refunded, as it is considered compensation for rental and hardware depreciation for the usage period.
6.3 Failure to Return: If the Subscriber does not return the equipment within 14 days of cancellation, Garage Coffee Bros will charge a penalty equal to 100% of the public list price of the retained equipment.
7. GIFTS AND PROMOTIONS (Elite Plan)
For the "Prosumer Elite" plan, the received gift (e.g., Kettle) is considered definitively acquired by the Subscriber upon payment of the semiannual advance. In case of termination after the 12th month, the Subscriber is not required to return the gift.
8. RESERVATION OF OWNERSHIP
The equipment is sold with a retention of title agreement pursuant to art. 1523 of the Civil Code. Ownership transfers to the buyer only upon payment of the last installment (12th monthly payment). Until then, the risks of loss or deterioration of the goods are borne by the Subscriber.
9. PRIVACY AND JURISDICTION
9.1 Personal data will be processed in accordance with the GDPR. 9.2 For any dispute arising from this contract, the Court of Verona will have exclusive jurisdiction, except for mandatory consumer protection laws.
