Terms of Sale

(pursuant to Chapter I, Title 3, Part 3, of Legislative Decree 206/2005 and subsequent amendments and additions)

1. INTRODUCTION AND EFFECTIVENESS OF THE GENERAL TERMS

These general terms of sale (hereinafter, “General Terms”) govern the purchase of products and services made remotely and made available via the internet through the website garagecoffeebros.com (hereinafter, the “Site”) in compliance with Italian law under Legislative Decree 206/2005 and subsequent amendments and additions (hereinafter, the “Consumer Code”).

The seller of the products and owner of the Site is: Garage Coffee Bros. srl, with registered office in Verona, via Basso Acquar 30C, Tax Code/VAT number and registration with the Verona Business Register no. 04571890237 – Email address: info@garagecoffeebros.com (hereinafter “Garage”).

The consumer accessing the Site to make purchases (hereinafter “Customer”) is required, before submitting the order, to carefully read these General Terms which have been made available on the Site and which can be consulted at any time by the Customer also through the link contained in the confirmation email of each order to allow reproduction and storage.

If the person making purchases on the Site requests the issuance of an invoice and/or is not a “consumer or user” as defined in Article 3, paragraph 1, letter a), of the Consumer Code, the withdrawal provisions under Articles 7 and 8 of these General Terms will not apply, nor, more generally, the provisions that under the same Consumer Code apply exclusively to “consumers.”

Contracts concluded with Garage through the Site are governed by these General Terms in compliance with Italian law. The languages available to conclude the contract are Italian or English. The language can be changed by the user using the appropriate link on the main pages of the Site.

2. CHOOSING AND ORDERING PRODUCTS

The features and prices of the various products for sale on the Site (hereinafter “Product” or “Products”) are shown on the page related to each Product.

To purchase Products, the Customer must complete and submit the electronic order form, following the instructions on the Site. The Customer must add the Product to the “Cart” and, after reviewing the General Terms and the Privacy Policy and confirming their acceptance, enter the shipping and any billing details, select the desired payment method, and confirm the order.

By submitting the order through the Site, which constitutes a contractual offer, the Customer acknowledges and declares to have read all the information provided during the purchase process and to fully accept these General Terms and the payment terms stated. Receipt of the contractual offer by Garage is confirmed by a specific summary email.

After confirming receipt of the contractual offer, the Customer has 2 hours to modify the submitted order by immediately notifying the email address: orders@garagecoffeebros.com. After 2 hours, the order will be processed and can no longer be modified by the Customer.

Once the order is received, Garage will check stock availability to fulfill the order (if the purchased product is roasted coffee, the check will concern the availability of the necessary quantity of green coffee in stock). If one or more Products are unavailable, Garage Customer Service will promptly notify the Customer by email, who will have 12 hours to respond to confirm shipment of any other available Products or to cancel the order. If no response is received within this time, the order will be considered confirmed and the available Products will be shipped. In this case, the full amount related to the missing Products will be refunded or, depending on the chosen payment method, will not be charged to the Customer.

The contract between Garage and the Customer is considered concluded upon acceptance of the order by Garage. This acceptance is communicated to the Customer via an order shipment confirmation email containing a reference to these General Terms, the order number, shipping and billing details, the list of ordered Products with their essential features, and the total price, including delivery charges.
Other emails sent before product shipment are not to be considered as acceptance, either implicit or explicit, of the order.

3. PRODUCT INFORMATION

Information and features related to the Products are available on the Site.

The visual representation of the Products on the Site, where available, normally corresponds to the photographic image accompanying the product description. It is understood that the image of the Products is intended solely to present them for sale and may not perfectly represent their characteristics and quality but may differ, for example, in color and size. In case of discrepancy between the image and the written product description, the product description shall prevail.

4. PRICES AND SHIPPING

Product prices include all taxes and duties. All prices are expressed in Euro. Shipping costs are determined by the system and shown to the customer before payment.
The currently applied indicative rates may change at any time.
In case of discrepancies between the shipping costs shown on the aforementioned page and those calculated on the site during checkout, the latter shall always prevail. No refund will be due by Garage to the customer if the shipping rates calculated at checkout are higher.

5. PAYMENT METHODS AND INVOICING

5.1 PAYMENT METHODS

The Customer can pay the price of the Products and related delivery charges by credit card or PayPal.

CREDIT CARD

The circuits through which purchases can be made on the Site are:
– Visa / Visa Electron
– Mastercard / Maestro
– AMEX
To ensure maximum security, the transaction will be carried out on the website of the financial operator processing the payment (payment gateway).

The Site does not store the Customer’s credit card number and therefore cannot be held responsible for any fraudulent use of these payment instruments.

PAYPAL

Once the order is confirmed, the Customer will be redirected to the PayPal site where they can make the payment using their account or a card, including prepaid cards, or according to the methods accepted by PayPal and in compliance with the related conditions.

5.2 ORDER INVOICING

If the purchase is made by a professional, it will be possible to request an invoice by sending billing details including tax code and/or VAT number to orders@garagecoffeebros.com. In this case, the invoice will be sent by email to the indicated address. The professional is responsible for correctly entering the billing data and is expressly informed that if the invoice is not requested at the time of order, it will not be possible to request it later.
