TERMS AND CONDITIONS OF SERVICE "ZERO WORRIES OFFICE MONTHLY SUBSCRIPTION CAPSULE - THE SWEET LIFE"

This contract governs the subscription service called "Capsule Coffee Club - Office Subscription" (hereinafter "Service") offered by Garage Coffee Bros (hereinafter "Provider") to the consumer/business Customer (hereinafter "Subscriber").
1. SUBJECT OF THE SERVICE
The service provides for the recurring monthly supply of Specialty coffee capsules (Nespresso® compatible) and, depending on the Plan, may include rental with purchase option of coffee preparation equipment. The subscription is available in 3 main variants (Plans), all configurable based on the volume of capsules (e.g. Standard 100 or XL 200 monthly):

"Office ESSENTIAL" Plan: Includes exclusively the monthly supply of "La Dolce Vita" capsules and Accessory Kit. Does not include hardware equipment and is designed for those who already own a compatible machine.

"Office SMART" Plan: Includes Capsule Machine, monthly supply of capsules, and Organizer/Capsule Holder. Ideal for the All-In-One solution.

"Office PRESTIGE" Plan: Includes Stainless Steel Sjöstrand Machine, monthly supply of capsules, Premium Drawer, Organizer, and Monthly Gift (e.g. 10 Single Origin Capsules).
2. DURATION, PURCHASE OPTION, AND RENEWAL
2.1 Binding Duration: The contract (for plans that include equipment) has a minimum binding duration of 12 (twelve) months starting from the date of subscription and payment of the "Entry Fee" (if applicable).
2.2 Ownership Purchase: For the SMART and PRESTIGE plans, during the first 12 months, the equipment remains the exclusive property of Garage Coffee Bros. Upon regular payment of the 12th monthly fee (twelfth recurring fee), ownership of the entire equipment (Machine and any accessories included in the plan) will be automatically and free of charge transferred to the Subscriber, who will become 100% owner.
2.3 Discounted Renewal (Post-12 Months): From the 13th month onwards, the contract will automatically renew indefinitely for coffee supply only. The monthly fee will be automatically reduced to the "Loyalty Price" (e.g. €59 for the 100 capsule plan or €119 for the 200 capsule PRESTIGE XL plan), since the equipment is now owned by the Subscriber.
3. FEES AND PAYMENT METHODS
The Customer agrees to the following payment structure:
3.1 Entry Fee: This amount is required only for plans that include high-end equipment (e.g. PRESTIGE Plan: €199.00). It is a one-time non-refundable fee covering setup costs, service activation, insured shipping, and initial hardware depreciation. For the Office ESSENTIAL Plan, the Entry Fee is not applicable.
3.2 Monthly Fee (Flat Rate): The Subscriber agrees to pay a fixed monthly fee for 12 months (e.g. €89.00 for the SMART Standard plan / €159.00 for the PRESTIGE XL plan). The charge will occur every 30 days on the indicated payment method.
3.3 Non-Payment: In case of failed automatic charge, Garage Coffee Bros reserves the right to immediately suspend shipments. If payment is not regularized within 15 days of the reminder, the contract will be considered terminated for breach, with the obligation to return the equipment (for SMART and PRESTIGE plans) and application of penalties as per article 6.
4. SUBSCRIBER'S OBLIGATIONS AND MAINTENANCE
4.1 Diligent Use: The Subscriber agrees to use the machine exclusively for domestic or office use, following the instructions provided in the user manual.
4.2 Ordinary Maintenance: The Subscriber is solely responsible for daily cleaning and periodic descaling of the machine (to be performed at least every 3-4 months or as indicated by the machine).
Note: Faults or malfunctions caused by limescale or neglect are not covered by warranty and repair costs will be charged to the Subscriber.
4.3 Prohibition of Transfer: The Subscriber may not sell, rent, lend, or transfer the equipment to third parties until ownership transfer has occurred (payment of the 12th installment).
5. SHIPPING AND WARRANTY
5.1 Shipping: Shipping costs for the monthly capsules and the first shipment of equipment are included in the fee.
5.2 Legal Warranty: The equipment is covered by a legal conformity warranty for the entire rental period (12 months) and thereafter according to legal terms. The warranty covers manufacturing defects but not accidental damage. During the first 12 months, Garage Coffee Bros guarantees assistance or a replacement machine in case of failure not attributable to neglect.
6. EARLY TERMINATION AND PENALTIES
The Subscriber may withdraw from the contract before 12 months (in plans that include equipment), under the following mandatory conditions:
6.1 Return: The Subscriber must return at their own expense all received equipment (Machine, Milk Frother, accessories) in excellent condition, clean, and complete with original packaging (necessary for safe transport).
6.2 Non-Refundable Entry Fee: In case of early withdrawal (before the 12th month), the initially paid "Entry Fee" (if applicable to the plan) will NOT be refunded under any circumstances, remaining acquired by the Provider as compensation for temporary use and commercial depreciation of the used asset.
6.3 Administrative Penalty: In addition to withholding the Entry Fee, Garage Coffee Bros reserves the right to charge a €50.00 administrative fee for early termination of the rental contract.
6.4 Failure to Return: If the Subscriber does not return the equipment within 14 days of the cancellation notice, Garage Coffee Bros will charge a penalty equal to 100% of the public list price of the retained equipment.
7. EARLY PURCHASE OPTION (Buy-Out)
The Subscriber may choose to terminate the monthly subscription and immediately acquire ownership of the machine by paying the difference between the list price of the equipment and the Entry Fee already paid.
8. GIFTS (Welcome Gift)
The set of cups or other welcome gifts provided at subscription are considered definitively acquired by the Subscriber upon payment of the Entry Fee. In case of withdrawal, such consumable goods do not need to be returned.
9. RESERVATION OF OWNERSHIP
The equipment (in the SMART and PRESTIGE plans) is granted with a reservation of ownership clause pursuant to art. 1523 of the Civil Code. Ownership transfers to the Subscriber only upon payment of the last installment (12th monthly fee). Until then, the risks of loss, theft, or deterioration of the asset are entirely borne by the Subscriber.
10. PRIVACY AND JURISDICTION
10.1 Personal data will be processed in accordance with the GDPR and Garage Coffee Bros' Privacy Policy.
10.2 For any civil dispute concerning the interpretation and execution of this contract entered into with a Consumer, the mandatory territorial jurisdiction lies with the court of the Consumer's residence or domicile, if located within the territory of the Italian State.
